Employee Contracts and Pay

Employee Contracts and Pay – Why It’s So Important to Get It Right!

Have you taken the time yet to consider all that goes into employing a domestic employee? After the recruitment process and interviews are done, you’ll need to review the terms of employment, or contract, as well as how you intend to pay your employee.

Why is a contract necessary?

There are two main reasons why you absolutely want to have an employment contract in place:

  1. It protects you, as an employer, by including items such as non-disclosure/confidentiality terms, defines expectations, dismissal offences, and your obligations
  2. It protects your employee, as an employee, by providing a clear outline of work, job security, and remuneration entitlements

Of course, we have no doubt that your employment relationship with your employee will run smoothly; however, it can’t hurt to have measures in place to ensure that the role is in line with legislation and that everyone is happy with the job position.

How should I pay my nanny or domestic worker?

The amount above the minimum award rate that you pay your employee is subject to market forces and will need to be negotiated.

Don’t forget that you will need to withhold PAYG tax from your employees’ pay and you may need to pay Superannuation as well. The frequency of pay runs should also be outlined in your contract and don’t forget you’ll need to provide a payslip within 1 day of payment.

If you have experience with paying household staff, it’s perfectly acceptable to stick to what you know! If this is your first experience, companies like CarePayCo can help take the hassle out of ensuring that you are compliant with regulations.
